Violent Crimes

Violent offenses include: assault, battery, assault with a deadly weapon, assault causing great bodily injury, attempted murder and murder. In essence, a violent crime occurs whenever one person, strikes, hits, harms or touches another person in an offensive manner. It could be as simple as spitting or as complex as poisoning. The offense can range from merely annoying the person (spitting, as in simple assault or battery) or causing serious injury or death (murder or assault with a deadly weapon).

All assault based crimes usually have some element of harm to the person. It is either through threatening, such as the offense of terrorist threats, or through actual physical contact, such as assault with a deadly weapon. At their core, someone is either hurt, or reasonably afraid of being hurt.

A lot of these offenses are charged, even when there is no intent to cause harm or fear on the part of the person accused. Sometimes, an overzealous prosecutor will raise a misunderstanding or mutual fight to a level that does not warrant criminal charges. In some situations, an accident led to tragedy or the need for self defense and preservation came to the forefront.

Whatever the cause of the allegations, the accused is often painted as blood thirsty and out of control. Accordingly, trying to represent oneself in court on these types of charges often proves to be very difficult. The prosecution is trying to portray the accused as a menace to society. Therefore, an attorney is often able to make inroads into the case that the self represented defendant cannot.

Many violent offenses often carry many years in prison as the potential punishment.  These types of crimes are considered the most serious in society.  As a result, the system is often willing to hand down its most serious punishments.  Murder, for instance, can carry the death penalty.  This is the only offense for which death is a possible punishment.  This is because it is considered the most severe crime, therefore, it merits the most severe punishment.

Convictions for other violent crimes carry some mandatory period of incarceration.  Simple assault and battery can even, depending upon the jurisdiction, carry some mandatory jail sentence.  These also often include period of probation with many different terms that must be completed, such as anger management and paying hefty fines.

Regardless of the immediate punishment, a record of violence is something that will often come back to haunt people later in life.  Therefore, no one should face these charges alone.  It is important to go to court with an attorney who can help you try to avoid these long term consequences.
