Domestic Violence

In this modern era, domestic violence is pursued by the State aggressively. Unlike most other violent crimes, spousal battery, also known as partner abuse or domestic abuse, has its own set of rules. It, like Driving Under the Influence, has become an issue where a mere accusation is enough to cause a person months, even years, of grief.

The police have special units for domestic abuse.   Once the police are called, the situation is out of the hands of the "victim."  It does not matter who called the police or why, but once law enforcement is involved, the person whom the police determine is the victim can do very little to slow or stop the progress of the criminal justice system. The prosecutors and police also have an army of counselors and psychologists at their disposal. These people are professionals whose sole job is to locate, identify and testify to the evils of domestic battery.  Seldom do these people believe the accused or accept that there is no domestic abuse in a home.

California has enacted legislation that provides for special penalties for a person convicted of a domestic violence crime as opposed to other violent crimes.  These include mandatory counseling and some mandatory restraints on personal freedom.  Furthermore, the Court has little authority to not enforce these provisions.
