You need an attorney who is tough and aggressive. The person you hire must be willing to fight for you and for your rights.
Most attorneys, at least in California, have been to law school. Not all law schools, however, are created equal. Find out if the attorney you want to hire went to a law school accredited by the American Bar Association. Find as much information as you can about the reputation of the law school that the Attorney attended.
All attorneys have been licensed by a State organization. Check with the State Bar of California to see if the person you want to hire is truly an attorney. The State Bar also ensures that all attorneys in California have some minimal level of competence and the Bar keeps records of attorneys who have been disciplined.
When talking about your case, minimal competence and a clean record are not enough. There should be only one goal the attorney has in mind, resolving your matter with as minimal impact on your life as possible. Sometimes, this means trial. Sometimes it means filing motions with the Court to attempt a dismissal of the case. At all times, it means putting the needs of the client first.
Many lawyers advertise how many trials they have completed. The sheer number of trials is often not a very helpful gauge in determining whether or not you have selected the right lawyer. There are a number of factors in determining why a case is tried that have absolutely nothing to do with the attorney at all. Whether or not a case is tried should be a decision for the client to make, not the lawyer.
The attorney you hire should have some trial experience. This will let you know if the lawyer you want to hire is willing to go the distance and fight for you. Furthermore, this trial experience should be recent.
Make sure you are comfortable with the person you want to be your lawyer. You are going to be asking this person for advice on how to resolve a situation that could have long lasting consequences for the remainder of your life. You want to make sure that the person you speak with is someone you can feel comfortable with and trust.
Some training, specialization or focus in the field of your concern may be useful. If the attorney tells you that he or she has some special training, try to find out more about that training:
Before you hire a law firm, find out who is actually going to be working on your matter. In many larger firms, the partner whose name is on the door does not get involved in many of the cases. These partners often pass on much of the work to associates. Ask to meet the attorney who will be working on your case. If you are not comfortable with that person, ask the partner to reassign the case. Always remember, it is your case and you have the right to know.
Remember, this is your case and your life. Make sure you hire the attorney that is right for you.
